These Terms and Conditions govern your use of the MindfulMail yearly subscription service (“Service”), operated by MindfulMail (“we”, “us”, “our”). By subscribing, you agree to these Terms in full.

2.1 The Service is offered either as an annual subscription at AUD $90 per year. Or as a monthly subscription at AUD $9 per month.
2.2 Your subscription grants you access to daily email prompts, exclusive content, and any additional features released during your subscription period.
2.3 The subscription is personal to you and may not be shared, transferred, or resold.
3.1 Subscription fees are billed upfront for either a monthly recurring, or a full 12-month period depending on the subscription selected.
3.2 By subscribing, you authorise us to automatically charge your nominated payment method each month or year until you cancel.
3.3 If a renewal payment fails, we may suspend or cancel your access to the Service until payment is successfully processed.
3.4 All prices are listed in Australian dollars and may be updated from time to time. Any price changes will be communicated with at least 30 days’ notice prior to renewal.
4.1 You may cancel your subscription at any time through your account settings or by contacting us directly.
4.2 Cancellation stops the next renewal. You will continue to have access until the end of your current paid period.
4.3 No refunds or partial credits are issued for unused days or months within an active subscription
5.1 MindfulMail does not offer refunds for change of mind or non-use of the Service.
5.2 Refunds may only be considered in cases of billing error or where required by Australian Consumer Law.
6.1 All Mindful Mail prompts, materials, branding, and content are owned or licenced by us.
6.2 Subscribers are granted a non-exclusive, non-transferable licence to access the content for personal use only.
6.3 You must not reproduce, distribute, modify, publish, or commercially exploit any content without prior written consent.
7.1 You are responsible for ensuring your email address is accurate and capable of receiving messages.
7.2 We are not liable for non-delivery caused by spam filters, email provider issues, or user error.
7.3 Delivery times may occasionally be adjusted for system maintenance or technical updates.
8.1 We may update, enhance, or modify the Service at any time.
8.2 Material changes that reasonably impact your subscription will be communicated via email or website notice.
We may suspend or terminate your subscription immediately if:
a) you breach these Terms;
b) fraudulent or unauthorised payment activity occurs;
c) we discontinue the Service entirely (in which case, a pro-rated refund for the unused portion of the yearly fee will be provided).
10.1 The Service offers general reflective and wellbeing content only and is not a substitute for mental health or medical advice.
10.2 To the maximum extent permitted by law, we are not liable for any indirect, consequential, or incidental loss arising from your use of the Service.
10.3 Nothing in these Terms restricts your rights under the Australian Consumer Law.
Your personal information is handled in accordance with our Privacy Policy. By subscribing, you consent to the collection and use of your data for the purpose of delivering the Service.
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved exclusively in the courts of NSW.
